1. Platform Purpose and Scope
musiciansXchange (the Service) is a collaboration platform that enables music creators to share WAV and MP3 audio files, discover collaborators, and work together on music projects. The Service provides tools for file sharing, version control with branch-based fork-and-merge workflows, real-time communication, timestamped audio commenting, automatic credit attribution, and project management. The Service is DAW-agnostic: it does not impose a recording tool on users and does not host live performance sessions.
2. Operator
musiciansXchange is operated independently. For legal inquiries, copyright concerns, or service-related communication, please use the in-platform feedback or service-request channels available from the user account menu.
3. Content Ownership
Users retain full ownership of all audio files, stems, mixes, and other content they upload to the Service. By uploading content, the user grants musiciansXchange a non-exclusive license solely for the purpose of operating the Service (storing the file, serving it to authorized collaborators, generating waveform peaks for timestamped comments, computing content checksums for audit trails). musiciansXchange does not claim ownership of user-generated content and does not use uploaded audio for any commercial purpose other than operating the Service.
4. Acceptable Use
Users may not upload content they do not have the legal right to share. Users may not use the Service to harass, defame, or threaten others. Users may not attempt to circumvent technical access controls, abuse the audit-logging system, or misrepresent their identity. Violations may result in account suspension or termination.
5. Copyright and DMCA
musiciansXchange respects intellectual property rights. If you believe content on the Service infringes your copyright, please use the in-platform user-report mechanism to submit a takedown request including (a) identification of the copyrighted work, (b) the URL of the infringing material, (c) your contact information, (d) a good-faith statement that the use is not authorized, and (e) a statement under penalty of perjury that the information is accurate. Repeat infringers will have their accounts terminated.
6. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. musiciansXchange does not warrant that the Service will be uninterrupted, error-free, or secure. Users are responsible for maintaining their own backups of important content; while the Service maintains redundant storage, no system can guarantee zero data loss.
7. Limitation of Liability
To the maximum extent permitted by law, musiciansXchange shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of the Service. In no event shall the total liability of musiciansXchange exceed the amount paid by the user to musiciansXchange in the twelve months preceding the claim.
8. Governing Law
These terms are governed by the laws of the operator's jurisdiction. Disputes will be resolved through binding arbitration where permitted by law.
